The terms and conditions as set out below are applicable to all orders placed by a customer on www.JodyStoneDesigns.co.uk. By placing an order you are entering into an agreement with Jody Stone Designs as specified above.

Jody Stone Designs specializes in jewellery and accessories.

Note that placing an order is a confirmation that you are 18 (eighteen) or older and have not had a legal guardian been appointed to you. Note that we do not enter into any agreement with individuals who are under 18 (eighteen) years of age and that your purchase is conditional on you accepting these terms and conditions.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store will also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Retention of Ownership & Withdrawal

With regard to customers: The ordered products remain the property of the Jody Stone Designs until full payment of the price is received.

In cases of breach of contract on the part of the customer (due, in particular, to defaulting in payment, falsification of information regarding creditworthiness, or legal settlement proceedings, or the initiation of insolvency proceedings against the customer's property) Jody Stone Designs will be entitled to withdraw from the contract and demand the return of the goods at any time if the customer has failed to provide - or has provided only in part – payment for the products ordered.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, videos and all Intellectual Property Rights related thereto, are the exclusive property of [Jody Stone Designs]. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Right to Suspend or Cancel User Account

We may permanently or temporarily terminate or suspend your account with Jody Stone Designs without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.

You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Promotional Emails & Content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please email JodyStoneDesigns@outlook.com.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the United Kingdom. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Warranty

We offer a 6 month warranty. When we receive a valid warranty claim for a product purchased from us due to faults & defects in craftsmanship, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us.

We will pay for shipment of repaired or replaced products to customer, but customer will be responsible for return shipment of the product to us. Please see returns policy for further details.

We are not under any obligation to correct the product, replace it or refund you if we notice that the defect stems from any of the following situations:

Wear and tear that is not considered normal for the product
Any defect that comes from you trying to repair or in other ways modify the product
Misuse or careless treatment of the product

Shipping

All orders are shipped from the UK and dispatched within 5 working days. After we have shipped your order our shipping partner needs 2-5 business days to deliver your parcel within the UK/EU. For shipments worldwide our shipping partner needs 5-7 business days.

In the event that your item has been lost by the postal system, we will remake your item once Royal Mail has declared it lost/missing. Unfortunately we cannot refund lost or missing items as we have upheld our side of the transaction.

Our Policies

Jody Stone Designs operates a complete privacy policy with regard to all information and data transmitted and received via this site and all other forms of correspondence. Jody Stone Designs does not pass on any details or information to any third parties without prior consent from the party/parties concerned. Any information collected by Jody Stone Designs is held in accordance with the United Kingdom’s Data Protection Act 2018 and the EU’s General Data Protection Regulation (GDPR).

Jody Stone Designs does not collect any personal information, except where knowingly and expressly provided by you. Any information provided via this website or any other form of correspondence, is held solely for Jody Stone Designs internal use. Any personal information provided by you will be used by Jody Stone Designs to provide further information about the services provided by Jody Stone Designs and to improve our services. By using the site, you agree to the collection and use of information in accordance with this policy.

Jody Stone Designs is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. We may also collect information on how the site is accessed and used (“Usage Data”). Purchase Transaction Data

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, it is implied that you consent to our collecting your purchase transaction data and using it for that specific reason only. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. Once completed, your purchase transaction information is deleted.

We use cookies and similar tracking technologies to track the activity on our site and hold certain information. Our Policies

Return & Refund Policy

For any undamaged product, simply return it with all included accessories and packaging, along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method.

In addition, please note that ‘Made to order/Custom’ products are not eligible for return, unless the fault/issue falls within the warranty conditions (see above).

Prior to returning undamaged goods in the 14 day window, please inform customer services that you wish to return the product & provide proof that the item is indeed undamaged.

Unfortunately, we are unable to cover the costs of return postage.

Faulty Items

If you are unfortunate enough to have received faulty item(s) please notify us immediately with proof/images of the fault/damage and we will offer a replacement or full refund following review.

We cannot be held responsible for damaged items following the buyer receiving & taking ownership of the goods. If items are found to be faulty after the initial 14 day period these are subject to warranty terms/Claims.

When returning items, Jody Stone Designs cannot be held responsible for any items lost or damaged in the post. We would recommend you obtain Proof of Postage or send them by registered or recorded delivery. Please include your name, address and order number when returning items.

International Postage

For customers ordering outside of the UK please ensure you check whether local Customs, Excise duty and\or tax is payable on the goods you are ordering. Customs & Excise duty varies from country to country and may or may not be applicable. It is your responsibility to be aware of any duties that might be applicable and to pay such duties.

Exchanges

All of the pieces available from Jody Stone Designs are one off creations, therefore I am unable to offer an alternative size. Please ensure the size selected is correct prior to placing your order.

If you have purchased a one off design that doesn't fit, you can check with your local jeweller if they can resize it for you. Unfortunately this isn’t a service we are able to offer once the selected Item(s) have been cast.
